How to interpret it

Accident insurance is a branch of personal insurance that covers risks arising from fortuitous events causing bodily harm. Unlike health insurance, which covers illnesses or general medical treatments, this insurance is specifically triggered by an accidental event. The Spanish legal definition, based on the Insurance Contract Law, requires the cause to be violent, sudden, external, and unintentional, thereby excluding occupational diseases or intentional injuries. Coverage may include indemnities for death, permanent or temporary disability, and medical expenses directly resulting from the accident.

Example

Hypothetically, if a driver injures their knee by tripping over a stone on the sidewalk while walking to their car, and as a result requires surgery and a two-month sick leave, the personal accident insurance policy would cover the medical expenses of the surgery and the indemnity for the temporary disability, provided the contract includes these coverages and the event meets the criteria of accidentalness (violent, sudden, external, and unintentional).

Why it matters to you

This insurance is important because it provides immediate economic protection against unforeseen events that may generate high medical costs or loss of income due to incapacity. It complements social security and other health insurance policies, offering a fixed or variable indemnity depending on the severity of the injuries, which helps stabilize the financial situation of the insured and their family during the recovery process.

Common points of confusion

It is frequently confused with occupational accident insurance, which is mandatory for workers and covers risks derived from work activities, whereas personal accident insurance is voluntary and covers risks in any area of life. It is also confused with health insurance, which covers illnesses and general medical treatments, not only those resulting from accidents. Furthermore, it should not be confused with civil liability, which covers damages caused to third parties, not to the insured themselves.
